Welcome to Colorfull Home (“we,” “us,” “our”). These Terms and Conditions (“Terms”) govern your use of our website at https://www.colorfullhome.com (the “Site”), our interior design services (including full-service design and e-design), and our curated shop (collectively, our “Services”).
By accessing our Site, engaging our Services, or purchasing products from our Shop, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or Services.
1. Overview of Services
Colorfull Home provides:
- Full-Service Residential Design: End-to-end interior design including space planning, custom millwork, furniture selection, procurement, and project management.
- E-Design / Virtual Design: Remote design services including concept boards, shopping lists, paint palettes, and implementation guidance delivered digitally.
- Curated Shop: Online sale of furniture, textiles, accessories, and home goods.
- Editorial Content: Blog posts, guides, and resources for design education.
These Terms apply to all Services unless a separate agreement is signed for a specific project.
2. Client Agreements & Service Scope
2.1 Engagement Agreement
All design services require a signed Client Design Agreement and an initial retainer or deposit before work begins. The Agreement outlines:
- Scope of work
- Deliverables and timeline
- Fees, payment schedule, and expenses
- Responsibilities of both parties
These Terms supplement the Client Design Agreement. In case of conflict, the Client Design Agreement governs the specific project.
2.2 Scope Changes
If the project scope changes (e.g., additional rooms, expanded renovations), we will provide a written Change Order outlining adjusted fees, timeline, and deliverables. Work on changed scope begins only after the Change Order is signed and any additional deposit is received.
2.3 Client Responsibilities
Clients agree to:
- Provide accurate information about their space, lifestyle, and budget
- Make timely decisions and approvals
- Provide access to the property as needed (for measurements, installations, etc.)
- Pay invoices according to the agreed schedule
- Not engage third parties to make design decisions that conflict with our scope without our written consent
3. Fees, Payment, and Expenses
3.1 Fees
Design fees may be structured as:
- Flat Fee: For defined scopes (e.g., single-room e-design)
- Hourly Rate: For consultations or additional services
- Cost-Plus: For products and furnishings marked up by a specified percentage
- Retainer + Milestone Payments: For full-service projects
All fees are stated in US Dollars (USD).
3.2 Payment Schedule
- Retainer/Deposit: Due upon signing the agreement to secure the timeline. This is non-refundable once work begins.
- Milestone Payments: Due as outlined in the Agreement (e.g., concept approval, procurement, installation).
- Final Payment: Due before final installation or delivery of e-design deliverables.
3.3 Late Payments
Invoices are due within 15 days of receipt unless otherwise specified. Late payments may incur a 1.5% monthly interest charge (or the maximum allowed by law). We reserve the right to pause work until payments are current.
3.4 Client Purchases
For full-service projects, clients are responsible for purchasing all furniture, materials, and construction costs unless we are managing procurement. We may place orders on your behalf; these are billed at cost plus our design fee or markup as stated in the Agreement.
3.5 Expenses
Clients are responsible for reimbursable expenses such as:
- Travel costs (if outside our local area)
- Shipping and handling
- Permit fees
- Third-party services (contractors, artisans, etc.)
Expenses will be itemized and pre-approved where possible.
4. E-Design & Virtual Services
4.1 Deliverables
E-design packages include digital deliverables such as:
- Concept boards and mood boards
- Furniture and finish plans
- Shopping lists with links
- Paint and color palettes
- Implementation guide
4.2 Client Execution
E-design is a DIY-adjacent service. Clients are responsible for:
- Purchasing items
- Coordinating with contractors, painters, or installers
- Measuring and verifying dimensions
- Implementing the design
We are not responsible for errors made during implementation by the client or third parties.
4.3 Revisions
E-design packages include a set number of revision rounds as specified in the Agreement. Additional revisions may be billed at our hourly rate.
4.4 No On-Site Visits
E-design does not include in-person measurements, site visits, or installation supervision unless explicitly stated in the Agreement.
5. Cancellation, Refunds, and Termination
5.1 Client Cancellation
If a client cancels after work has begun:
- The retainer/deposit is non-refundable
- Clients are billed for all work completed up to the cancellation date
- Any procured items that are non-returnable remain the client’s responsibility
5.2 Termination for Cause
We may terminate services if:
- Payments are not made within the specified timeframe
- The client breaches the Agreement
- The project becomes unfeasible due to client actions or circumstances
5.3 Refunds on Shop Purchases
Shop refunds follow our Refund & Return Policy (linked separately). Design service fees are generally non-refundable once work has commenced.
6. Intellectual Property
6.1 Design Ownership
All design concepts, drawings, plans, mood boards, and creative materials (“Design Materials”) are intellectual property of Colorfull Home until full payment is received. Upon full payment:
- Clients receive a limited, non-transferable license to use the Design Materials for their property only
- Clients may not resell, license, or share the Design Materials with third parties for other projects
6.2 Portfolio Rights
We retain the right to photograph, film, and showcase completed projects in our portfolio, marketing materials, social media, and press. If a client requests privacy (e.g., for security or personal reasons), we will honor this in writing and exclude the project from public showcases.
6.3 Shop Products
Products sold in our Shop are licensed for personal, non-commercial use only. You may not resell, reproduce, or distribute them without our written permission.
7. Limitation of Liability
7.1 Professional Services
Design services are provided with professional care and expertise. However:
- We are not responsible for errors by contractors, artisans, or third-party vendors
- We are not liable for construction defects, code violations, or safety issues arising from third-party work
- We do not provide architectural, engineering, or structural advice unless explicitly engaged and licensed to do so
7.2 Maximum Liability
To the maximum extent permitted by law, Colorfull Home’s total liability for any claim arising from our Services or Site shall not exceed the total fees paid by the client for the specific project giving rise to the claim.
7.3 Indemnification
Clients agree to indemnify and hold Colorfull Home harmless from claims, damages, or losses arising from:
- Client’s implementation of design recommendations
- Client’s use of third-party contractors or products
- Client’s breach of these Terms
8. Shop Terms & Product Information
8.1 Product Accuracy
We strive to display product colors, textures, and dimensions accurately. However:
- Monitor settings and lighting affect how colors appear
- Natural materials (wood, stone, textiles) vary by batch
- We are not responsible for minor variations
8.2 Pricing & Availability
- Prices are in USD and subject to change without notice
- Products may go out of stock; we will notify you if an order cannot be fulfilled
- We reserve the right to limit quantities and cancel orders due to pricing errors or availability issues
8.3 Shipping & Delivery
- Shipping times and costs are calculated at checkout
- We are not responsible for delays caused by carriers, customs, or force majeure events
- Risk of loss passes to the client upon delivery to the carrier
8.4 Returns & Exchanges
Shop returns are governed by our separate Refund & Return Policy. Design service fees are non-refundable once work begins.
9. Website Use & Disclaimers
9.1 Content Ownership
All content on this Site (text, images, graphics, logos, blog posts, guides) is owned by Colorfull Home or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
9.2 Personal Use Only
You may view and use our Site for personal, non-commercial purposes. You may not:
- Scrape, crawl, or automate data extraction
- Use our content for commercialMD purposes without permission
- Attempt to hack, compromise, or disrupt the Site
9.3 Editorial Content

11. Governing Law & Dispute Resolution
11.1 Governing Law
These Terms are governed by the laws of the State of Oregon, United States, without regard to conflict of law principles.
11.2 Dispute Resolution
- Negotiation: Parties agree to attempt good-faith negotiation to resolve disputes.
- Mediation/Arbitration: If negotiation fails, disputes shall be resolved through binding arbitration in Portland, Oregon, in accordance with the rules of the American Arbitration Association.
- Class Action Waiver: Claims must be brought on an individual basis, not as a class action.
11.3 Venue
Any legal action not subject to arbitration shall be brought in the federal or state courts of Portland, Oregon, and you consent to personal jurisdiction there.
12. Miscellaneous
12.1 Entire Agreement
These Terms, together with the Client Design Agreement and Privacy Policy, constitute the entire agreement between you and Colorfull Home regarding our Services.
12.2 Amendments
We may update these Terms from time to time. The Last Updated date at the top reflects the current version. Continued use of our Site or Services after changes constitutes acceptance of the new Terms.
12.3 Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.
12.4 Waiver
Failure to enforce a provision does not constitute a waiver. We must waive rights in writing to be effective.
12.5 Assignment
You may not assign your rights under these Terms without our written consent. We may assign our rights without restriction.
